PLUMBING CALL FLOW — TERMS OF SERVICE

These Terms of Service (“Terms”) govern access to and use of the Plumbing Call Flow platform (the “Service”).
The Service is operated by Ira Blatt & Associates, doing business as Plumbing Call Flow (“Company”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Eligibility

You must be at least 18 years old and authorized to enter a binding agreement on behalf of your business.

You agree to provide accurate contact and billing information and keep it current.


2. Service Description

The Service is a communication-handling and notification platform designed for service businesses.

Core functions include:

• AI-assisted inbound call answering
• Call handling and routing
• Caller information capture
• Call summaries and job alerts delivered to the account holder

The Service sends notifications to the business owner or authorized users so they may follow up with customers.

The Service does not contact your customers on your behalf after the call and does not operate as a marketing, outreach, or lead-generation messaging platform.

The Service is a software automation tool only.
It is not a human receptionist, dispatcher, employee, or agent acting on behalf of your business.

You remain fully responsible for:

• responding to customers
• scheduling jobs
• pricing and service decisions
• all business outcomes

The Company does not guarantee leads, bookings, revenue, or customer satisfaction.

Future or optional features that allow outbound messaging may require additional registration, consent collection, or compliance verification before activation.


3. Acceptable Use

You agree not to:

• Violate applicable laws or regulations
• Misrepresent your business identity
• Attempt to disrupt or overload the system
• Use the Service for spam, robocalling abuse, or unlawful communications
• Use the platform in a manner that creates telecom compliance risk

Violation may result in suspension or termination without refund.

You are solely responsible for how you communicate with your customers after receiving alerts from the Service.


4. Subscription & Usage Charges

The Service operates on a recurring monthly subscription basis.

The base service fee is $97 per month and provides access to the AI Phone Agent system,

service phone number, website, and job alert functionality.

In addition to the base fee, usage-based charges apply based on call activity through the assigned service phone number.

Usage is measured based on total call time connected through the assigned service phone number,

whether handled by the AI Phone Agent, forwarded, or otherwise connected through the system.

Billing is based on system-recorded call duration.

Current usage rates are $0.18 per minute, billed periodically throughout each billing cycle based on usage activity.

Rates are subject to change with notice.

Usage charges increase with call volume and duration and are not capped. Higher usage

typically reflects increased customer call activity.

The total monthly cost therefore consists of the $97 base service fee plus applicable usage charges.

Usage fees are based on actual system activity, remain payable after cancellation, and are non-refundable.

Actual charges depend entirely on call volume and call duration and may vary

significantly from month to month. No specific usage amount is guaranteed or represented.


5. Authorization to Charge

By subscribing, Customer authorizes Company to automatically charge the payment method on file for:

• subscription fees
• accumulated usage charges
• applicable taxes or regulatory fees

Charges may occur on different dates within a billing cycle based on usage activity.

Failure of payment may result in service interruption.


6. Cancellation

You may cancel your subscription at any time through your account portal or by contacting support.

Cancellation stops future subscription renewals.
Previously incurred usage charges remain payable.

No prorated refunds are provided for partial billing periods.

7. 30-Day Money-Back Guarantee

If Customer is not satisfied with the Service, Customer may request a refund within thirty (30) days of the initial activation date.

The guarantee applies to the $97 monthly subscription fee.

Usage charges reflect actual system activity and are not refundable.

Any usage incurred prior to cancellation remains payable.

After the first 30 days, all payments are non-refundable.


8. Payments & Non-Payment

Customer must maintain a valid payment method.

If payment fails, Company may:

• retry charges
• pause or limit service
• require updated payment information

Customer remains responsible for all charges incurred prior to suspension.


9. Service Availability

We strive for reliability but do not guarantee uninterrupted service.

The following may occur:

• outages or delays
• transcription inaccuracies
• AI misunderstanding caller intent
• incomplete or missed information

The Service is provided “as-is”.

The Phone Numbers and telephony features provided by Plumbing Call Flow are for business inquiries and customer communications only.

They are not intended for, and may not be capable of, placing 911 or other emergency calls.

Customer is solely responsible for maintaining alternative phone service that supports emergency calling and for communicating appropriate emergency instructions to its staff.

Customer must not advertise any Plumbing Call Flow number as an emergency line for life-safety situations.


9. Limitation of Liability

To the maximum extent permitted by law, Company’s total liability shall not exceed the amount paid for the Service during the previous one-month billing period.

Company is not liable for:

• missed calls
• lost customers
• lost profits
• business losses
• indirect or consequential damages


10. Notifications

The Service sends operational alerts and call summaries to the account holder and authorized users regarding inbound communications.

These alerts are system notifications intended solely to inform the business of customer contact activity.

The Service does not send marketing or follow-up messages to the business’s customers on the business’s behalf.


11. Privacy

Use of the Service is governed by the Privacy Policy.

You consent to operational notifications and data processing necessary to operate the platform.


12. Termination

We may suspend or terminate access if:

• these Terms are violated
• fraudulent activity occurs
• excessive disputes or chargebacks occur
• the Service is abused or creates compliance risk


13. Governing Law

These Terms are governed by the laws of the State of California, United States.
